Why Mediation?

Jobs, businesses or just life can get real messy. Lawsuits may be necessary but are expensive, time consuming, and risky. When a case goes to a judge or jury, so does all of your control. The result may be a glorious victory, a crushing defeat, or an award of less than the amount you could have settled for months earlier.

Mediation allows you to have the most control over the outcome for your dispute. At Robert Gray Palmer Co., LPA, Bob Palmer provides mediation services as an experienced neutral. Bob can help parties create a reasonable and satisfactory resolution that avoids the high expense, time and risks of litigation through this confidential process.

Bob has successfully mediated cases involving serious injury, wrongful death, business, employment, professional negligence and many other types of disputes. He is a member of the National Association of Distinguished Neutrals, member of the American Bar Association Section of Dispute Resolution, and has lectured on mediation.

How He Works - Mediation

Sometimes, the court orders it. Sometimes, the parties choose it for themselves. But however you get there, it is important to know what mediation is, and what it is not.

Mediation works differently than other areas of the law. It's a process by which an impartial person – the mediator – facilitates negotiation between opposing parties and helps them make thoughtful decisions to resolve disputes.

The mediator is neutral to the outcome. There are no sides to take. There is no argument to advance. There is no client to fight for or protect. There is only the mediator doing a kind of "shuttle diplomacy," completely focused on getting resolution and achieving what's reasonable and acceptable for all parties involved.

Bob's broad range of civil litigation experience is enhanced by years of work as a mediator both privately and for the courts. He regularly volunteers his services as a neutral to the United States District Court. He has mediated cases in Ohio and out of state. He has lectured on mediation and has received special training at the American Bar Association Dispute Resolution multi-day conferences in 2010, 2013, 2014 and 2015 as well as attending the Advanced Mediation and Advocacy Skills Institute in 2013. In December 2013, Bob was inducted to the Ohio Chapter of the National Academy of Distinguished Neutrals. He was a Delegate to the 2017 International Academy of Mediators’ Conference in Austin, Texas and will be inducted as a Fellow of the IAM in May, 2018 in Edinburgh, Scotland.

He Can Mediate Your Case, Too

Bob has successfully mediated disputes about contracts, breach of fiduciary duty, business dissolutions, construction litigation, employment contracts and terminations, employment discrimination, insurance coverage, insurance bad faith, intentional torts, legal and other malpractice, civil rights and discrimination, as well as personal injuries and wrongful death.

Sometimes it falls to the left. Sometimes it falls to the right. My job here is indeed, quite difficult.

The Experience Behind It All

Underlying Bob's mediation work is his more than 40 years experience as a trial lawyer handling a wide variety of complex litigation, including cases involving insurance coverage and bad faith claims, business disputes, employment, serious personal injuries (including wrongful death and traumatic brain injury), breach of fiduciary duty cases, professional negligence and more.

If there is an answer to settle the differences between two opposing parties, I will find it. Right, Fluffy?

Integrity. Creativity. Experience. And Patience. Lots Of Patience.
